The High Risk Realities of Managing Contract Workforces
Operating an enterprise in industrial belts, manufacturing hubs, logistics parks, or IT corridors requires relying on security guards, housekeeping personnel, facility staff, and specialized contract labour. However, operating under the CLRA framework creates critical legal and financial exposures.
Passed On Principal Employer Liability
Under Section 21 of the CLRA Act, the Principal Employer is legally and financially responsible for unpaid wages, unremitted EPF, and missing ESIC contributions if a manpower contractor defaults.
Operating Without Mandatory Registrations & Licences
Engaging 20 or more contract workers without a valid Principal Employer Registration Certificate (Form II) or allowing contractors to work without a Labour License (Form VI) leads to immediate compounding penalties, work stoppage orders, and prosecution.
The Threat of Sham Contract Claims
If documentation, supervision structures, or wage disbursement methods are mismanaged, contract workers can claim direct employment status, leading to protracted industrial disputes and court ordered absorption.

When does a business require a CLRA Principal Employer registration?
Under the Contract Labour (Regulation and Abolition) Act, any commercial establishment, corporate office, or factory that employs 20 or more contract workers on any single day of the preceding 12 months must obtain a Registration Certificate (Form II) from the State Labour Department.
What is Form V, and why is it essential for contractor licensing?
Form V is a certificate issued by the Principal Employer to a contractor. It certifies that the contractor has been awarded a contract to perform work at the establishment and specifies the maximum number of contract workmen permitted. The contractor must submit Form V to the Licensing Officer to obtain their Labour License (Form VI).
Is the Principal Employer liable if a contractor defaults on wages or PF/ESI?
Yes. Under Section 21 of the CLRA Act, if a contractor fails to pay statutory wages or makes unauthorized deductions, the Principal Employer is legally bound to disburse the wages directly. Furthermore, EPFO and ESIC authorities hold the Principal Employer vicariously liable for any defaulted social security contributions.
What registers must be maintained at the site for contract labour?
Mandatory registers include Form XII (Register of Contractors), Form XIII (Register of Workmen Employed by Contractor), Form XIV (Employment Cards), Form XVI (Muster Roll), Form XVII (Register of Wages), Form XIX (Wage Slip), and Forms XX to XXIII (Registers for Deductions, Fines, Advances, and Overtime).
How does Samarthana's monthly contractor audit protect our business?
Before your accounts team pays a contractor’s monthly invoice, we audit their billed worker list against biometric attendance, bank transfer wage statements, and verified EPF/ESIC challans. This ensures the contractor has completely fulfilled their statutory duties, eliminating pass through liability for your organization.
