The Compliance Challenge
challenges
The Operational Hurdles of Securing Statutory Approvals
Operating an enterprise in commercial corridors, tech parks, or manufacturing belts requires navigating a rigid, multi tiered licensing framework. Whether you are an industrial plant, an IT firm, or a manpower contractor deploying personnel, securing licenses presents critical challenges.
Strict Statutory Thresholds & Legal Exposures
Deploying 20 or more contract workers without a valid Contract Labour Licence (Form VI) or engaging contractors without a Principal Employer Registration Certificate (Form II) violates the CLRA Act, exposing directors to heavy fines and imprisonment.
Complex Multi Department Procedures
Securing approvals across State Labour Departments, Factory Safety Inspectorates, and municipal bodies requires separate portal applications, specific document formats, and precise treasury challan payments. A single document mismatch halts the entire approval process.
Tender Disqualifications & Frozen Invoices
Leading enterprise clients and public sector undertakings mandate valid statutory licenses before awarding contracts or clearing vendor invoices. Missing or expired licenses freeze cash flows and stall projects.

When is a Contract Labour Licence mandatory?
Under the Contract Labour (Regulation and Abolition) Act, 1970, any contractor who employs 20 or more workmen on any single day of the preceding 12 months for an establishment must obtain a Labour Licence (Form VI) from the Licensing Officer of the State Labour Department.
What is the difference between CLRA Registration and a Labour Licence?
CLRA Registration (Form II) is obtained by the Principal Employer, the company hiring the contractor, to legally engage contract labour at their establishment. A Labour Licence (Form VI) is obtained by the Contractor, the manpower supplier, authorizing them to supply a specific number of workers to a registered Principal Employer based on a valid Form V certificate.
What documents are required to apply for a Contract Labour Licence (Form VI)?
The primary documents required include a Form V Certificate issued and signed by the registered Principal Employer, a completed Form IV Application with contractor details, worker headcounts, and contract duration, a copy of the Principal Employer’s Registration Certificate (Form II), proof of payment of statutory government fees and security deposit treasury challans, and the contracting agency’s PAN, GST registration, and incorporation documents.
How does the labour licence renewal process work?
Labour licenses must be renewed before their expiry date. The contractor must submit Form VII alongside proof of payment for the prescribed renewal fees. If renewed prior to expiry, operations continue uninterrupted. Applying after expiry leads to late surcharges or requires submitting an entirely new application.
Does Samarthana handle Factory Licences and Plan Approvals?
Yes. As experienced factory licence consultants, we manage the complete lifecycle under the Factories Act, 1948. We prepare factory building plan submissions (Form 1), coordinate with state approved Competent Persons for structural stability certifications, secure initial Form 4 factory licenses, and manage multi year renewals.
