Challenges

challenges

The High Risk Realities of Industrial Manufacturing

Operating a plant in manufacturing belts involves rigorous regulatory scrutiny. Unlike standard commercial offices, manufacturing facilities are strictly monitored by the relevant State Factory Safety Inspectorate. Factory occupants and managers face significant ongoing operational liabilities.

Unannounced Safety & Labour Inspections

Joint Directors and Factory Inspectors conduct detailed on site examinations. Missing a single statutory register (such as Form 25 or Form 17), failing to display approved layouts, or running uncalibrated safety equipment results in immediate show cause notices.

Complex Factory Licensing & Expansion Roadblocks

Modifying production lines, installing additional horsepower (HP), or scaling workforce numbers without prior plan approval (Form 1) and license amendments (Form 2) invalidates existing operational approvals.

Severe Personal Liabilities for Occupants

Under Section 92 of the Factories Act, non compliance, particularly regarding safety equipment, fire exits, and pressure plants, is a criminal offense that exposes factory directors and designated occupants to heavy compounding fines and imprisonment.

Common Questions

FREQUENTLY ASKED QUESTIONS

When does a manufacturing unit require a Factory Licence?

Any manufacturing premises must obtain a Factory Licence from the relevant safety authority if it employs 10 or more workers and carries out a manufacturing process with the aid of electrical power, or 20 or more workers without the aid of power.

The Factories Act governs manufacturing and industrial premises where transformation, assembly, or repair processes take place, with strict safety oversight. The applicable Shops and Establishments Act applies to commercial offices, corporate IT establishments, and retail stores, and is governed by the state Labour Department without requirements for industrial safety layouts or stability certificates.

An occupant can apply for a factory licence renewal for a single calendar year or opt for a multi year renewal covering up to 10 consecutive years. Renewal applications must be submitted via Form 2 alongside the prescribed statutory treasury challan before the end of the year to prevent late renewal surcharges.

Form 1 accompanied by detailed questionnaire data, plant and site drawings displaying the building layout, natural lighting, ventilation, and emergency exits, machinery layout drawings, a structural stability certificate issued in Form 1A by a state recognized Competent Person, and a flowchart of manufacturing processes.

We conduct proactive pre audit mock inspections to identify documentation gaps, examine physical safety guards, and verify shop floor muster rolls. During an official inspection, we assist management in presenting statutory records and prepare professional, legally sound replies to any inspection reports or show cause notices.
