The Compliance Challenge
challenges
The Legal and Cultural Realities of Managing Workplace Safety
Operating an enterprise in commercial corridors, tech parks, or manufacturing belts involves strict statutory oversight regarding workplace safety. Under the POSH Act, any establishment employing 10 or more people must maintain an active compliance framework. Without expert governance, employers face severe risks.
Heavy Statutory Penalties & Cancellation of Licenses
Failure to constitute an Internal Committee (IC) or submit the required annual return can result in fines, repeated penalties, and cancellation of business licenses.
Flawed Inquiry Procedures & Legal Invalidation
An improperly constituted committee or non compliant inquiry process can invalidate POSH proceedings, leading to legal disputes and procedural challenges.
Lack of Ongoing Awareness
Without regular POSH awareness and sensitization for employees and contract workers, organizations remain exposed to compliance gaps and legal liabilities.

Is POSH compliance mandatory for all businesses?
Yes. Under the POSH Act, every organization employing 10 or more persons, regardless of whether they are full time, part time, temporary, or contract employees, must constitute an Internal Committee, formulate a policy, organize mandatory sensitization workshops, and file annual returns.
Why is an External Member required on the Internal Committee?
Section 4(2)(c) of the POSH Act legally mandates the inclusion of an External Member who is from an NGO, an association committed to the cause of women, or a person familiar with sexual harassment issues. The External Member ensures neutrality, prevents managerial bias, and guarantees that complaints are handled objectively under the principles of natural justice.
What are the legal penalties for non compliance with the POSH Act?
Initial non compliance carries a financial penalty of up to 50,000 rupees for failing to constitute an IC, failing to act on committee recommendations, or failing to submit the annual return. Repeat offenses bring doubled financial penalties and potential cancellation or non renewal of business licenses, registrations, or statutory operating approvals. Flawed internal inquiries can also result in wrongful termination lawsuits and reputational damages in labour and civil courts.
How often should POSH training be conducted?
Under Rule 13 of the POSH Rules, the employer is legally obligated to organize sensitization programs at regular intervals for all employees, alongside specialized training workshops for Internal Committee members. Best practice mandates conducting employee awareness sessions annually and training new hires during onboarding.
What is the deadline for filing the POSH Annual Report?
The Internal Committee must prepare and submit an Annual Report summarizing complaints received, actions taken, and workshops conducted, to the employer and to the designated District Officer, on or before January 31st of each year for the preceding calendar year.
