The High Risk Realities of Managing EPF & ESIC
Operating an enterprise in commercial hubs, IT corridors, or manufacturing belts requires strict adherence to central social security mandates. Between the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952 and the Employees’ State Insurance Act, 1948, employers face severe ongoing compliance hurdles.
Strict 15th of the Month Deadlines
Statutory contributions for both EPF and ESI must be calculated, reconciled, and deposited via electronic challans by the 15th of every month. Missing this date by even a single day results in penal damages under Section 14B and simple interest at 12% per annum under Section 7Q.
Data Discrepancies and Portal Rejections
Unseeded Aadhaar numbers, mismatched Universal Account Numbers (UAN), date of joining errors, and digital signature certificate (DSC) expirations consistently disrupt monthly ECR uploads, creating compliance bottlenecks for internal HR teams.
Heavy Financial and Legal Penalties
Non compliance is not merely an administrative oversight. Defaulting on employee deductions can lead to direct attachment of company bank accounts, prosecution under Section 85 of the ESI Act, and non bailable warrants issued by the regional labour judiciary.

When is PF and ESI registration mandatory for a business?
EPF registration is mandatory for any commercial establishment or factory employing 20 or more persons. ESI registration is mandatory for establishments employing 10 or more persons where workers earn a gross monthly wage of 21,000 rupees or less (25,000 rupees for employees with physical disabilities). Establishments with fewer employees can also opt for voluntary registration under Section 1(4) of the EPF Act.
What are the financial penalties for missing the 15th of the month filing deadline?
Delayed remittance past the 15th triggers penal damages under Section 14B (EPF), ranging from 5% up to 25% of the defaulted contribution depending on the period of delay; statutory interest under Section 7Q (EPF) at 12% per annum on the outstanding amount from the due date until actual payment; and ESI penalties including interest at 12% per annum for each day of default alongside comparable damages and prosecution under Section 85 of the ESI Act.
Can an employer contribute to EPF above the statutory wage ceiling?
Yes. The statutory wage ceiling for mandatory EPF coverage is 15,000 rupees basic wages plus DA. However, employers and employees can jointly opt under Para 26(6) of the EPF Scheme to contribute 12% on the actual higher basic salary.
How does Samarthana resolve pending EPFO Section 7A inquiries and inspection notices?
Our team conducts a detailed pre audit of your past wage registers, payment vouchers, and general ledgers. We identify discrepancies, prepare legal submissions, calculate correct liabilities, and represent your company before the Regional PF Commissioner and recovery officers to resolve the matter and mitigate damages.
Does Samarthana manage ESI dispensaries and biometric Pehchan cards for employees?
Yes. Our team handles the complete employee onboarding cycle: registering the insured person, uploading family KYC details, generating Temporary Identification Certificates (TIC), mapping local dispensaries, and assisting employees in obtaining permanent biometric Pehchan cards.
